SCULPTOR TERMS & CONDITIONS

These Terms and Conditions govern the entry of sculptures into the NZ Rural Sculpture Awards.

By submitting an entry via the official registration form and paying the applicable entry fee, the entrant (“the Sculptor”) enters into a legally binding agreement with the Kimbolton Arts & Sculpture Trust (“the Trust”) and agrees to be bound by these Terms and Conditions.

1. The Parties

This agreement is between:

  • The Kimbolton Arts & Sculpture Trust (“the Trust”), and

  • The registered artist (“the Sculptor”).

2. The Event

The Trust presents the Kimbolton Sculpture Festival, held in Kimbolton, Manawatū.

The Trust reserves the right, at its discretion, to:

  • Accept or decline any entry (following consultation with the Sculptor where practicable)

  • Refuse, relocate, or require modification of any sculpture deemed unsafe or inappropriate for public display

3. Entry Requirements

All sculpture entries must:

  • Comply with the Award Conditions published on the ruralart.nz website

  • Be submitted via the official online entry form

  • Be principally conceived and constructed by the Sculptor

  • Be original works that have not previously been exhibited in public exhibitions or competitions

  • Be structurally sound, securely installed, and safe for public interaction and display

  • Be available for sale on the day of the festival and via ruralart.nz for 30 days following the event, unless otherwise stated on the entry form

4. Sculptor Obligations

The Sculptor must:

  • Complete registration, provide all required information, and pay the entry fee by the closing date

  • Accept these Terms and Conditions by the closing date

  • Be the legal owner of the submitted work

  • Be available by phone during judging (Friday afternoon)

  • Ensure all legal, regulatory, and safety requirements are met prior to installation

  • Consent to the use of their name, images, and artwork for media and promotional purposes

5. Installation, Access, and Removal

  • Sculptures must remain on site until 4:00 pm on the day of the festival

  • Vehicles are permitted on site only during designated drop-off (Thursday/Friday) and collection times (from 4:00 pm Saturday or Sunday as advised)

  • Sculptors are responsible for collecting unsold works from the designated area after the festival

6. Security and Insurance

The Trust will take reasonable care to ensure the security of all exhibited works; however:

  • All artworks remain at the Sculptor’s risk

  • The Trust accepts no liability for loss, theft, or damage during the festival

  • Sculptors are responsible for arranging their own insurance if required

Overnight security will be provided between 5:00 pm and 7:00 am on Thursday, Friday, and Saturday nights.

7. Display Opportunities

Following the festival, sculptors may be invited to discuss opportunities to display their work in or around Kimbolton.

8. Awards and Judging

  • Awards are determined at the sole discretion of the appointed judges

  • No correspondence will be entered into regarding judging decisions

9. Sales and Commission

All sculpture sales during the festival must be processed through the Festival Office.

9.1 Exclusivity

The Sculptor grants the Trust exclusive rights to sell any sculpture listed for sale during the festival and for 30 days thereafter via the ruralart.nz website.

9.2 Commission

  • The Trust will retain a 20% commission on all sales

  • The Sculptor will receive the remaining 80% of the sale price

9.3 Payment

Payment to the Sculptor will be made by internet banking within three (3) working days of the sale, less commission.

9.4 Promotion

The Trust may promote artworks via:

  • ruralart.nz

  • Kimbolton Sculpture Festival social media channels

as it considers appropriate.

10. Freight and Delivery

  • Unless otherwise agreed in writing, all freight, packing, insurance, and delivery costs are the responsibility of the purchaser

  • The Sculptor is responsible for coordinating delivery directly with the purchaser

11. Liability for Sold Works

  • The Sculptor remains responsible for the artwork until it is delivered to the purchaser

  • The Trust accepts no liability for loss or damage during packing, freight, or delivery

12. Disputes

  • The Trust will not mediate disputes arising from the sale of artworks

  • Any unresolved disputes should be referred to the Disputes Tribunal

13. General Disputes

Any matter not covered by these Terms and Conditions will be determined by the Trustees of the Trust, whose decision will be final.
